1. General
    1. Art Arnhem takes place in the Eusebius Church in Arnhem.
    2. The organisation of Art Arnhem is in the hands of De Kunst Collega’s B.V., (hereinafter referred to as ‘the Organisation’), in cooperation with Stichting Kunstweek.
    3. The costs for renting, heating and cleaning of the Eusebius Church, the basic layout of the exhibition, the crew, sending press releases, newsletters and so on, the construction and updating of the website, general management and administration, ticket sales, printed matter, correspondence and so on are for the Organisation.
    4. Artists who wish to present themselves during Art Arnhem fully and unconditionally accept these participation conditions.
  2. Sign up for participation
    1. Artists apply for participation in Art Arnhem by means of an e-mail in accordance with the procedure as stated under the link ‘sign up’ on the website of the fair.
    2. Applications for participation will be assessed by a Balloting Committee.
    3. All members of the Balloting Committee are professionally involved in the visual arts on a daily basis.
    4. In the first instance, the applications will be assessed by assessing the submitted images of work that is representative of what the artist wishes to exhibit during Art Arnhem and c.v. of the artist in question..
    5. If further information is necessary for the assessment of the Balloting Committee, the artists may be asked for.
    6. After the balloting, the artists concerned will be informed by e-mail which artists have been admitted to Art Arnhem and how the artists can effectively register and choose their stand.
    7. Artists who are not admitted will also be notified by e-mail and the costs paid will be refunded.
    8. In some cases a stand can be shared. The link to the terms and conditions can be found at the bottom of this page.
  3. Cancellation of participation
    1. Unsubscribing from participation must be done in writing by e-mail (info@artarnhem.nl) or by regular mail. Unsubscription will generally be confirmed by the Organisation within five working days.
    2. For cancellations up to 9 weeks prior to the exhibition, 40% of the total participation fee is due.
    3. For cancellations from 6 weeks prior to the exhibition, the full participation fee will be due regardless of the reason.
    4. If a participant, with or without deregistration, does not exhibit on one or both days of Art Arnhem, the full participation fee is due regardless of the reason.
    5. If a participant has taken out cancellation insurance, the general provisions of the cancellation insurance apply (link at the bottom of this page).
  4. The exhibition
    1. Participants can indicate their preference for an exhibition place in the Eusebius Church.
    2. Participants may address visitors in the immediate vicinity of their exhibited works of art during the exhibition.
    3. Participants may issue leaflets, postcards and/or business cards to visitors. They may also place leaflets, postcards and/or business cards on a tray made available by the Organisation (tray size: A4 landscape).
  5. Presentation possibilities and design of the stands
    1. Each participant will have an exhibition space reserved for him or her: a booth with hard walls at his or her disposal.
    2. If a stand can be enlarged, this will be compensated by a fee specified by the Organisation.
    3. In the booth, hanging works are attached with perlon cords, suspension hooks and adjustable hooks. Cords and hooks are made available by the Organisation.
    4. For the use of, among other things, the presentation platform, the badge, the stand, suspension systems, a table and/or chair and any other hired extras, a cash deposit of € 50,- is due, which will be refunded in full and again in cash at the end of the exhibition when all goods made available are returned undamaged.
    5. Damage caused, for example to the exhibition walls and/or hired materials, will be recovered from the participants concerned and, insofar as the deposit is sufficient, will be deducted from the deposit.
    6. Pedestals and any other attributes to exhibit standing or lying three-dimensional works must be brought by the participants themselves.
    7. Because of the desired harmony, the use of self-supplied spotlights, chairs and tables is not permitted.
    8. It is not allowed to place or hang works outside the rented stand without explicit permission of the Organisation.
    9. In some cases (also) the outside and/or back of a stand can be used to exhibit a hanging work. In those cases where this is possible, a fee as indicated by the Organisation will be due.
    10. The Organisation will lend each participant a layer of A4 presentation tray free of charge.
    11. The Organisation has tables available, which can be rented. When renting a table, a black cover is included for a nice presentation.
    12. A maximum of 1 table and 1 chair is allowed per stand.
    13. Only in the stands a maximum of two (extra) nameplates are allowed. An additional name indication may not be larger than 15 cm high and 40 cm wide.
    14. If the Organisation provides name indication on the stand, a maximum of 25 letters and characters can be placed on the nameplate. If more letters and characters are desirable, more nameplates must be made or smaller letters and characters must be used. Additional nameplates are subject to charges.
    15. The walls of the stands are 2.5 metres high. All works must fit in width and depth within the rented exhibition area.
    16. There is no minimum spacing between the works to be exhibited.
    17. For the sake of harmony in presentation and a professional appearance, it is not allowed to place 2D works on the floor.
    18. Exhibiting works above and below each other is strongly discouraged. It is preferable to exhibit works next to each other. This is also because of the harmony in presentation and a professional appearance.
    19. It is not allowed to dismantle the stand during the opening hours of the fair.
    20. It is not allowed to offer consumptions, other than those of the caterer, at the stand.
  6. Quality of the works of art
    1. The participants can decide for themselves which works will be exhibited, there are no restrictions with regard to style, materials used and age.
    2. The works to be exhibited must be dry (paint/glue) and may not contain sharp objects, poisonous or otherwise dangerous substances.
    3. The works to be exhibited must be completely ready for exhibition, i.e. framed (or stretched) and provided with a solid suspension system or, in the case of a sculpture, immediately placeable.
  7. Delivery and collection
    1. The stand must be set up on the day before the first day of the fair within the time period indicated by the Organisation. The times at which the stand must be set up will be announced to the participants well in advance.
    2. If it is impossible to be present within this time period, this must be announced to the Organisation by e-mail (info@artarnhem.nl) at the latest 1 month before the first day of the exhibition, so that, if possible, the time allocation can be taken into account.
    3. If the stand is set up outside the indicated time period, additional costs will be charged. These extra costs amount to € 45,-.
    4. Unsold works of art must be collected after the fair, on Sundays between 17.40 and 20.00 hours.
    5. If the works of art are not collected on the day and time indicated above, storage costs are due. For the first seven calendar days, starting on the last day of the fair, these costs are € 10 per work per 24-hour period. Thereafter € 5,- per work per day (amounts are inclusive of VAT).
    6. If a work is not collected three months after Art Arnhem, it will be forfeited to the Organisation free of charge.
  8. Sale of exhibited works
    1. The exhibited works of art may be offered for sale and sold on the spot or later.
    2. The artist himself determines the selling price. This is inclusive of VAT and should preferably be mentioned by the artist on or directly next to the work or on the pedestal.
    3. In case of sale, no commission is owed to the Organisation.
    4. If an exhibited work is sold and taken directly by the buyer, it may be replaced by another work accepted by the Organisation for exhibition at the fair.
    5. If it is not the participant, but the Organisation that effects and/or handles a sale, € 30,- in administration costs will be withheld from the payment of the purchase price.
  9. Mentions of names of exhibiting artists and publication of images of works
    1. The Organisation will mention the names of the exhibiting artists in the manner and places it wishes.
    2. These mentions are free of charge for the exhibiting artists, unless explicitly agreed otherwise in advance.
    3. Exhibiting artists grant the Organisation the right to use images of their works for publication without further permission and without compensation.
  10. Insurance
    1. If this wish has been indicated by the exhibiting artist, the works to be exhibited on the day prior to Art Arnhem and on the days of Art Arnhem itself are insured from the moment they are placed in the stand until the moment they are removed from the stand.
    2. There are costs associated with insuring the works, which are indicated to the exhibiting artists by the Organisation.
    3. The Organisation bears no liability for matters other than the exhibited works of art and only in so far as these are covered by the insurance.
  11. Costs
    1. Participation fees are due for participation in Art Arnhem. The participation fee will be announced by the Organisation to the participants upon registration for participation. The participation fee depends on the size of the stand and the extras to be hired, such as extra lighting and furnishing of the stand.
    2. You can choose to make use of certain additional services or products. As a rule, this is subject to costs.
    3. The invoice for participation must be paid within the set period, unless otherwise agreed in writing. If payment is not made on time, the Organisation is entitled to outsource the collection, whereby the costs will be for the participant.
    4. All amounts mentioned in these general terms and conditions are exclusive of VAT, unless stated otherwise.
  12. Liability, suggestions and complaints
    1. The Organisation constantly strives to improve all aspects of the fair and to optimize the services provided to participants and visitors. Suggestions for improvement of the service by the participants are highly appreciated and suggestions that lead to improved returns, more visitors or lower costs, for example through better purchasing or less personnel costs, are rewarded with a part of the benefit during execution.
    2. In spite of the great care that is taken to keep to the agreements made, it can happen that the Organisation makes little mistakes. Complaints made in writing will be dealt with up to two weeks after the fair. In all cases, a complaint will be responded to within a few days up to a maximum of 1 week.
    3. Under no circumstances persons are liable for the actions of the Organisation. In the event of differences of opinion, complaints and other matters that may be current, the legal entity within which the organisation falls must be addressed.
    4. The liability is in all cases limited to the sum of the participation fee.
    5. The Organisation is not liable for any damage to works of art at any time: not during the exhibition, not during storage and not during transport or on the way to or from the fair. For damage to and theft of the exhibited works of art, insurance can be taken out.
  13. Other provisions
    1. The Organisation and third parties engaged by it are not liable for any damage, direct and/or indirect, arising from or in any other way connected with the intent, care and implementation of Art Arnhem. In the event that works are damaged by the Organisation, the damage will be compensated insofar as it is covered by the insurance.
    2. Despite the care that the Organisation devotes to the management of its website(s) and the design, care and implementation of Art Arnhem, it is possible that the information provided and/or displayed may be incomplete or incorrect. Printing, spelling, typesetting or other errors in the material published by the Organisation, of whatever nature, cannot be charged to the Organisation and may in no way constitute an obligation on the part of the Organisation.
    3. The Organisation reserves the right to change the location of the exhibition if, in the opinion of the Organisation, there are compelling reasons for doing so. In this case, participants will retain exhibition space of the same size. In the event of a change of location, the participants cannot claim compensation or reduction of the amounts associated with the participation. Neither can the Organisation charge the participants for the change of location.
    4. The Organisation reserves the right to cancel or postpone Art Arnhem, without prior notice, without being liable in any way to pay damages to the participants or third parties. In the event of cancellation, all costs paid for participation will be refunded within 14 days after deduction of 10% costs. If the exhibition must be cancelled, postponed or shortened due to force majeure or unforeseen circumstances, such as fire, storm damage, flooding, threat of terrorism, calamity at the exhibition location (for example a bomb threat or danger of collapse), a government measure, inaccessibility of the exhibition location, threat of war or an epidemic, the Organisation can under no circumstances be held responsible for the consequences. In these cases, participants cannot claim compensation or restitution of amounts due and/or paid for participation. In such cases, the Organisation will make every effort to allow a cancelled exhibition to continue at a later date. Until now, a cancellation without a shift has never occurred at any exhibition organised by the Organisation.
    5. The provisions set out in these terms and conditions of participation may be modified at any time without further notice. Arrangements made before adjustment will remain in force with the conditions applicable to the adjustment.
    6. This version of the general provisions is effective from 1 January 2019. The Dutch version of the Conditions of participation applies to the event. Translations serve as a guide for those who do not speak the Dutch language.
    7. In cases of differences of opinion regarding the interpretation of what is laid down in these Conditions of participation, the opinion of the Organisation shall be decisive.
    8. In cases not provided for in these Conditions of participation, the Organisation will judge and act in all reasonableness.
    9. Dutch law shall apply to these terms and conditions of participation.
